| What is eContract? eContract (also known as Electronic Contract) is defined in Article 33 of the 2005 Law on Electronic Transactions as follows: "An electronic contract is a type of agreement where the parties agree to establish, modify, or terminate rights and obligations which are sent, received, and stored on electronic media such as electrical, electronic, digital, optical technologies, and other electronic means." In simple terms, an eContract is a contract created and signed electronically, without the need for paper documents. What is eSign? eSign (also known as Digital Signature) refers to information attached to data for the purpose of verifying the identity of the data sender and ensuring that the data has not been altered. The legal basis for eSign (Digital Signature) is governed by Decree No. 130/2018/ND-CP (Detailed regulations on the implementation of the Law on Electronic Transactions regarding Digital Signatures and Digital Signature Authentication services) and Circular No. 16/2019/TT-BTTTT (Regulations on mandatory standards for digital signatures and authentication services, including mobile and remote signature models). |
